An Unfair Labor Practice (ULP) is a violation of the National Labor Relations Act (NLRA), which can be committed by either the company or the union.
What union behaviors violate the NLRA?
- Threatening employees that they will lose their jobs unless they support the union's activities.
- Refusing to process a grievance because an employee has criticized union officers.
- Fining employees who have resigned from the union for engaging in protected activity.
- Asking the company to fire an employee for not complying with a union security agreement, when the employee has paid or offered to pay a lawful initiation fee and periodic dues.
- Refusing a referral or giving preference in a hiring hall on the basis of race or union activities.

Since 2015, 5,023 ULP charges have been filed against the Teamsters for complaints ranging from "Threatening Statements" and "Harassment" to "Duty of Fair Representation" and even "Violence/Assaults".
