The National Labor Relations Board (NLRB) has announced the details of the secret-ballot election (Notice of Election).
Who: All full-time and regular part-time Drivers, Driver Trainee-Navigators, and back-up drivers who were employed during the payroll period ending July 5, 2025.
Date: Friday, August 8, 2025
Times: 5:00 am to 8:00 am and 10:30 am to 1:30 pm
Location: Conference Room at the Employer's facility (33375 Central Ave, Union City, CA 94587)
Others Permitted to Vote
The parties have agreed that dispatchers may vote in the election, but their ballots will be challenged since their eligibility has not been resolved. No decision has been made regarding whether the individuals in these classifications or groups are included in, or excluded from, the bargaining unit. The eligibility or inclusion of these individuals will be resolved, if necessary, following the election.
Eligible team members are free to vote at any time the polls are open.
Employee NOT Eligible to Vote
All other employees, including without limitation, office clerical employees, professional employees, confidential employees, material handlers, third-party contractors, third-party workers, contingent contractors, contingent workers, guards, and supervisors, as defined by the Act are not eligible to vote in the election.
The vote will be by secret ballot and will be conducted and overseen by a representative from the National Labor Relations Board (NLRB), a branch of the Federal Government.
Observers selected by U.S. Venture and the union will also be present at the voting site at all relevant times to ensure the election is conducted appropriately and fairly. They are just there to observe the election and make sure all rules are followed. No one will know how you vote unless you tell them.
The NLRB representative will bring portable voting booths, a secret ballot box, and the ballots. Team members will be given an official ballot by the NLRB representative and directed to the voting booth.
The ballot will be a piece of paper and will ask the following question:
"Do you wish to be represented for purposes of collective bargaining by Teamsters Local 853?"
Two empty boxes will appear under the question: one underneath the word "YES" and one underneath the word "NO." The ballot will direct you to mark an "X" in the box of your choice.
After marking the box of your choice, you will then fold the ballot in half and place it in the secret ballot box.
Do not write your name or make any marks on the ballot other than a single mark in the box of your choice. Doing so may disqualify your vote.
We hope that you all take the opportunity to vote. Don't let other people decide your future without having a say. The election outcome will be determined by the majority of the people who vote.
So, for example, if out of 39 team members, only 10 team members vote and 6 vote for the union, then those 6 team members determine the future for all 39 team members, including those who voted against the union and those who didn't vote at all.
